On June 5, 2019, Professor Kong Xiangjun, the dean of Kaiyuan Law College of Shanghai Jiaoting University and used to be the member of the Judging Committee of the Supreme People's Court and the President of the Intellectual Property Court, was invited to give a lecture on the newly revised anti-unfair competition law content interpretation and the law application of trademark use by Shanghai Greroyalt & Co,

Firstly, Professor Kong gave a lecture on the law application of trademark using. Combined with his rich theoretical foundation and practical experience, Professor Kong expounded using behavior of trademark in trademark law from the origin of legal definition and OEM processing and export. Taking the law as the starting point and core, Combined with a number of cases, trials and research experience, Professor Kong explained in detail which behaviors belong to the actual use of trademarks. Questions raised by participants were also answered.


Then, Michelle Xu, senior partner of Shanghai Greroyalt & Co., discussed and shared a trademark infringement lawsuit heard by Guangzhou court. By giving a brief account of the whole case, Michelle shared some experience on how to combine legal awareness and business awareness in litigation, how to arouse the judge's inner approval and how to visualize evidence materials focusing on action strategy, evidence fixed, litigation skills and other aspects. And proposed how to break through the use the independent legal person system to prevent natural persons from assuming tort liability, such as the courts are still reluctant to "Pierce the veil of the company" which triggered the thought of the participants.

         
 After the tea break, Professor Kong explained the contents of the newly revised anti-unfair competition law. Mainly centered on the terms of the commercial secret revision contents and background, the "electronic intrusion" means, the "breached the contract" and "breach of confidentiality obligations", the abetting, seduce, aiding tort, the subject of the infringement of trade secrets as well as on commercial secret infringement litigation evidence rules, etc.
